By accessing or using the Etherly VPN service (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

Etherly provides a virtual private network (VPN) service that encrypts your internet traffic and routes it through our servers. The Service supports VLESS+Reality, WireGuard, and Hysteria2 protocols.

3. Account Registration

Accounts are created using a cryptographic seed phrase. You are solely responsible for the security of your seed phrase. We cannot recover or reset your seed phrase. Loss of your seed phrase means permanent loss of access to your account.

4. Acceptable Use

You agree not to use the Service to:

• Engage in any illegal activity under applicable law
• Distribute malware, viruses, or other harmful software
• Send spam or unsolicited communications
• Attack, disrupt, or compromise other networks or systems
• Distribute child exploitation material
• Violate the intellectual property rights of others

We reserve the right to suspend or terminate accounts that violate these terms.

5. Payment and Subscriptions

The Service is offered on a subscription basis. All payments are made in cryptocurrency (USDT or SOL) and are processed on-chain. Prices are displayed in USD and converted at the current market rate at the time of payment.

• Subscriptions begin immediately upon payment confirmation
• Subscription periods are cumulative — purchasing a new plan extends your expiry date
• Prices are subject to change; existing subscriptions are honored at the purchased rate

6. Refund Policy

We offer a 30-day money-back guarantee on all plans. If you are unsatisfied with the Service within the first 30 days of your subscription, contact us at noreply@etherly.one to request a refund. Refunds are issued to the original payment address.

7. Service Availability

We strive to maintain high uptime but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from service interruptions.

8. Limitation of Liability

The Service is provided “as is” without warranties of any kind. To the fullest extent permitted by law, Etherly shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

9. Modifications

We may modify these Terms at any time. Changes take effect when posted on this page. Continued use of the Service after changes constitutes acceptance. We recommend reviewing these Terms periodically.

10. Governing Law

These Terms are governed by and construed in accordance with applicable international law. Any disputes shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
